Legal & Statutory Notice

HookUpApi // Last revised: October 2026 // Governing law: Kingdom of Spain / European Union

1. Privacy Policy (GDPR)

EU 2016/679

HookUpApi ("we", "us"), located at Rúa do Bidueiro, 10, Oleiros, A Coruña, Spain, is the data controller for personal data collected through this website and our commercial communications. You may reach our data desk at [email protected].

1.1 What We Collect

When you submit an inquiry through our contact console or correspond with us by email or phone, we process: your name, work email, phone number, company name, budget band, project brief content, and any files you voluntarily provide. We also process strictly technical logs (IP address, user agent, timestamps) required to operate and secure the website.

1.2 Purpose & Legal Basis

Inquiry data is processed under Article 6(1)(b) GDPR (steps prior to a contract) and Article 6(1)(f) (our legitimate interest in responding to commercial inquiries and defending the security of our systems). Client project data is processed under Article 6(1)(b) to perform the engineering contract you engage us for. We do not engage in automated decision-making or profiling.

1.3 Retention & Hosting

Unconverted inquiries are retained for a maximum of 24 months from last contact. Client project records are retained for the duration of the engagement plus the statutory commercial and tax retention periods required under Spanish law (typically 6 years). All production data is hosted within the European Union on infrastructure protected by encryption in transit (TLS 1.3) and at rest (AES-256).

1.4 Your Rights

Under the GDPR you have the right to access, rectify, erase, restrict, and port your personal data, as well as to object to processing and lodge a complaint with a supervisory authority. To exercise any right, write to [email protected]. We respond within 30 days.

1.5 Sub-Processors

We engage a limited set of vetted sub-processors for email delivery, payment processing (Stripe), and cloud hosting. Each is bound by data-processing agreements compliant with Article 28 GDPR. A current sub-processor list is available on request via the email above.

2. Terms of Service

COMMERCIAL T&C

These terms govern every engagement between the client and HookUpApi for software engineering, infrastructure, and advisory services. By commissioning work (via written agreement, statement of work, or payment of an invoice/quote), the client accepts these terms.

2.1 Scope & Statements of Work

Each engagement is defined by a written statement of work (SOW) specifying deliverables, milestones, turnaround windows, and the fixed price or retainer rate. Work outside the SOW scope is quoted separately before execution. Quote validity is 14 days from issue.

2.2 Payment Terms

Fixed-scope projects are invoiced 50% on kickoff and 50% on delivery acceptance, unless the SOW states otherwise. Retainers are invoiced monthly in advance. Invoices are payable within 14 calendar days via the payment link we provide (Stripe) or bank transfer. Late payments accrue the maximum statutory interest permitted under Spanish law plus reasonable recovery costs.

2.3 Intellectual Property

Upon receipt of full payment, HookUpApi assigns all worldwide intellectual property rights in the client-specific deliverables — source code, configurations, design assets, and documentation — to the client. We retain rights to pre-existing frameworks, internal libraries, and generic know-how, which are perpetually licensed to the client as needed to operate the deliverables. Third-party open-source components remain under their respective licenses.

2.4 Delivery, Acceptance & Cooperation

Delivery dates depend on the timely provision of access, credentials, content, and feedback by the client. A deliverable is deemed accepted 10 business days after delivery if no written defect report is submitted. Legitimate defects are remedied at no cost within a reasonable window.

2.5 Confidentiality

Both parties keep confidential all non-public information disclosed during the engagement. HookUpApi may reference the client's name and general project scope in its portfolio after public launch, unless the client opts out in writing.

2.6 Liability

To the maximum extent permitted by law, HookUpApi's total aggregate liability under any engagement is limited to the total fees actually paid by the client for that engagement in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages. Nothing in these terms limits liability for fraud, willful misconduct, or any liability that cannot be limited under applicable law.

2.7 Governing Law

These terms are governed by the laws of Spain, without prejudice to mandatory consumer protections. Disputes are first attempted to be resolved amicably; failing that, the courts of A Coruña, Spain have exclusive jurisdiction, subject to any mandatory alternative venue.

3. Cookie Policy

ePrivacy / LSSI-CE

This website uses cookies and similar storage technologies. Below is a complete inventory of what we set and why, in line with the ePrivacy Directive and Spanish Law 34/2002 (LSSI-CE).

3.1 Strictly Necessary Cookies

cookie_accepted — a first-party localStorage entry that records your acceptance of this banner so it does not reappear on every page. This is required for the site's basic operation and does not need consent. Session security cookies may also be set to protect form submissions against forgery.

3.2 Analytics & Third-Party Cookies

We do not load analytics, advertising, or social-embedding trackers by default. Should we introduce optional measurement tools in the future, they will remain disabled until you actively consent via an updated banner, and this policy will be revised accordingly.

3.3 Managing Cookies

You can clear or block cookies at any time through your browser settings (Chrome, Firefox, Safari, Edge all provide cookie controls). Blocking strictly necessary storage may cause the consent banner to reappear on each visit, but the rest of the site remains fully usable. For questions, contact [email protected].

4. Refund & Reimbursement Policy

BILLING

We price fixed-scope engineering work up front so invoices stay predictable. This policy explains when refunds apply and how they are processed. Payments are handled via Stripe; approved refunds are returned to the original payment method within 5–10 business days.

4.1 Unstarted Work — 14-Day Window

If a kickoff deposit or prepaid invoice covers work that has not yet started, you may request a full refund within 14 calendar days of payment. "Not started" means no discovery session has occurred and no code, configuration, or design work has been delivered.

4.2 Milestone-Based Cancellation

For in-flight fixed-scope projects, you may cancel at any milestone boundary. We retain payment for milestones already completed and for any work-in-progress prorated up to the cancellation date, and we deliver all completed work product to you. The balance, if any, is refunded within 10 business days.

4.3 Retainers

Monthly maintenance retainers can be cancelled with 30 days' written notice to [email protected]. The current month already billed is non-refundable; no further charges are made after the notice period ends. Unused support hours do not roll over unless the SOW explicitly states otherwise.

4.4 Defects & Re-Delivery

If a delivered milestone materially fails to meet the SOW specification, notify us in writing within 10 business days of delivery. We will re-deliver conforming work at no additional charge. Persistent failure to deliver the contracted scope entitles you to a pro-rata refund for the non-conforming portion.

4.5 Non-Refundable Items

Completed and accepted milestones, third-party licenses or hosting fees paid on your behalf, and rush/ASAP surcharges for work already performed are non-refundable. Chargeback requests should contact us first — we resolve billing disputes quickly and directly.

4.6 How to Request a Refund

Email [email protected] from the address used on the invoice with the subject "Refund Request", your invoice number, and a one-line reason. We acknowledge within one business day and resolve eligible requests within five. Outstanding invoices can be settled directly via our secure Stripe payment link.
